TERMS AND CONDITIONS

Welcome to United Veteran Benefits Agency ("UVBA," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of unitedveteran.com, its pages and forms, and related website-based communications and services (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you enter into a separate written agreement with UVBA for paid services, that agreement also applies. If these Terms conflict with that agreement concerning the paid services, the separate written agreement controls.
1. About UVBA and Our Services
VBA is a private, fee-based, non-accredited VA disability claims consultancy. We provide information and support related to VA disability claims, which may include helping clients organize information and documentation, understand portions of the claims process, and prepare claim-related materials.

UVBA is not part of, endorsed by, or affiliated with the U.S. Department of Veterans Affairs (VA) or any other government agency. UVBA is not a law firm, does not provide legal representation, and does not provide medical advice, diagnosis, or treatment. Information on the website is for general educational and informational purposes and is not a substitute for advice from an accredited representative, attorney, medical professional, or government agency.

Services are subject to eligibility, availability, applicable law, and any separate written agreement. We may modify, suspend, or discontinue website features or general service offerings at any time. Changes to an active client engagement will be handled according to the applicable client agreement.
2. No Guarantee of Benefits or Claim Outcome
Every VA disability claim is determined by the VA based on the claimant’s individual circumstances, evidence, applicable law, and VA procedures. UVBA does not control VA decisions or processing times and does not guarantee that a claim will be approved, that a disability rating will increase, that benefits will be awarded, or that any particular outcome or timeframe will occur.
3. Eligibility and Authority
You must be at least 18 years old and legally capable of agreeing to these Terms to use the Services. If you use the Services on behalf of another person or organization, you represent that you have authority to act for that person or organization and to bind them to these Terms where legally permitted.
4. Acceptable Use of the Website
You agree to use the website only for lawful purposes. You may not:
  • Use the website in a manner that violates applicable law or the rights of another person.
  • Submit information that is knowingly false, fraudulent, misleading, defamatory, unlawful, or that you do not have the right to provide.
  • Attempt to gain unauthorized access to the website, accounts, systems, networks, or data.
  • Introduce malware, harmful code, automated scraping tools, denial-of-service activity, or other technology that disrupts or burdens the website.
  • Impersonate another person, misrepresent your identity or affiliation, or interfere with another user’s access.
  • Copy, reproduce, republish, distribute, sell, or commercially exploit website content except as expressly authorized in writing.
We may restrict or terminate access to the website when we reasonably believe these Terms have been violated or access creates legal, operational, or security risk.
5. Information You Provide
You are responsible for the accuracy and completeness of information you submit. You represent that you have the right to provide the information and documents you send to UVBA. Do not submit information about another person unless you are authorized to do so.

You grant UVBA permission to use information and materials you provide as reasonably necessary to respond to your inquiry, evaluate or deliver requested services, communicate with you, operate our business, and comply with law, subject to our Privacy Policy and any applicable client agreement.
6. Privacy
UVBA’s collection and handling of personal information is described in our Privacy Policy, available at https://unitedveteran.com/privacy-policy. The Privacy Policy is incorporated into these Terms by reference. Please review it before submitting personal or sensitive information.
7. Intellectual Property
The website and its content—including text, graphics, logos, branding, photographs, videos, designs, software, and arrangement—are owned by or licensed to UVBA and are protected by copyright, trademark, and other intellectual-property laws.

UVBA grants you a limited, revocable, nonexclusive, nontransferable license to access and use the website for personal, lawful, noncommercial purposes. No ownership rights are transferred to you. Except as permitted by law, you may not reproduce, modify, distribute, publicly display, create derivative works from, or commercially exploit website content without UVBA’s prior written permission.
8. Third-Party Websites and Services
The website may contain links to third-party websites, tools, or services. Those links are provided for convenience and do not necessarily imply endorsement. UVBA does not control and is not responsible for third-party content, availability, security, terms, or privacy practices. Your use of third-party services is governed by their own terms and policies.
9. Website Availability and Changes
We work to keep the website available and accurate, but we do not guarantee uninterrupted access, error-free operation, or that all information will always be complete, current, or suitable for a particular purpose. We may update, remove, restrict, or suspend website content or functionality without notice, including for maintenance, security, legal, or operational reasons.
10. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." UVBA DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES REGARDING THE WEBSITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law. Any warranties expressly stated in a separate written client agreement are governed by that agreement.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UVBA AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, BENEFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO USE OF OR INABILITY TO USE THE WEBSITE OR RELIANCE ON GENERAL WEBSITE CONTENT.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Liability relating to paid services is also subject to any applicable separate client agreement.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless UVBA and its owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, or information or materials you submit in violation of another person’s rights. This provision does not require indemnification for UVBA’s own unlawful conduct.
13. SMS/Text Message Terms
Program Description and Consent
When you sign up for text messages from United Veteran Benefits Agency, you are signing up to receive messages related to your relationship with UVBA. Consent to receive SMS messages is separate from consent to receive email or telephone communications. You may opt in during intake discussions or by initiating an SMS conversation with us. By providing a mobile number and opting in, you authorize UVBA to send text messages to that number, which may include messages sent using automated technology. Consent to receive SMS messages is not a condition of purchasing or using UVBA’s services.
Types of Messages
Messages may include:
  • Responses to your initial message or other inquiries.
  • Appointment, intake, or document reminders.
  • Benefits information.
  • Notifications and service updates.
  • Claim-related communications.
  • Customer-support or assistance messages.
An example message is: ‘Hello, thank you for contacting United Veteran Benefits Agency. How can we help you? Reply STOP to opt out at any time. Message and data rates may apply. For assistance, reply HELP.’
Frequency, Charges, and Delivery
Message frequency varies based on your interactions with UVBA and the services you request. Message and data rates may apply to messages sent to you from us and to messages you send to us under your mobile carrier’s plan. Neither mobile carriers nor United Veteran Benefits Agency are liable for delayed or undelivered messages.
Opt-Out, Re-Enrollment, and Help
‍
To stop SMS messages, reply STOP at any time. Your opt-out request will generate one final message confirming that you have been unsubscribed. You will no longer receive SMS messages unless you opt in again. You may opt back in by replying START or through another authorized UVBA opt-in method.

For assistance, reply HELP within the text-message thread or call 573-412-5100.
Mobile Information and SMS Consent
Mobile opt-in information, SMS consent records, and telephone numbers collected for SMS communication purposes will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. We may disclose this information to service providers and subcontractors that support delivery of our text-message program, but only as necessary to provide those services on UVBA’s behalf. SMS opt-in data and consent will not be used for unrelated third-party marketing.
14. Changes to These Terms
We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Changes apply when posted unless a later date is stated. Material changes affecting an active paid service will be handled in accordance with the applicable client agreement and law.
15. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, except to the extent federal law applies or applicable law requires otherwise.
16. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect, and the affected provision will be enforced to the maximum extent permitted by law. UVBA’s failure to enforce a provision is not a waiver of its right to do so later.
17. Entire Agreement
These Terms and the Privacy Policy constitute the agreement between you and UVBA concerning use of the website. Any separate written client agreement governs the paid services covered by that agreement.
